Excelsior Under Attack: Dissecting Harvard’s Appeal to the NLRB

Following an inconclusive union representation election for Harvard’s teaching and research assistants in November 2016, the regional labor board director in Boston ordered a new election after finding that Harvard left over 500 eligible voters off the “Excelsior list” provided to union supporters in elections. Harvard appealed the regional director’s decision to the National Labor Relations Board, asking the Board to consider a change in the law that could reduce employers’ responsibility to provide complete and accurate lists.

Shelley B. Kroll from the New England-based labor and employment law firm Segal Roitman will join the Labor and Employment Action Project to discuss the implications of Harvard’s appeal for the larger labor movement.
