LIDS Live will post brief introductions to their posts, and direct you to the Blog to read the rest.<\/em><\/p>\n<p>It is the one-year anniversary of the U.S. Supreme Court\u2019s decision in <a title=\"Kiobel slip opinion\" href=\"http:\/\/www.supremecourt.gov\/opinions\/12pdf\/10-1491_l6gn.pdf\" target=\"_blank\"><em>Kiobel v. Royal Dutch Petroleum Co.<\/em><\/a> In its decision, the Court narrowed the admissibility of <a title=\"ATS wiki page\" href=\"http:\/\/en.wikipedia.org\/wiki\/Alien_Tort_Statute\" target=\"_blank\">Alien Tort Statute (ATS)<\/a> claims related to extraterritorial human rights abuses, ruling that\u00a0such claims are not actionable unless the claim has a sufficient nexus to U.S. territory. What kind of nexus is enough for an ATS case arising from exterritorial conduct? For cases involving foreign multinational companies, such as the defendant Royal Dutch Petroleum in <em>Kiobel<\/em>,\u00a0a <a title=\"Analysis of Kiobel\" href=\"http:\/\/www.earthrights.org\/blog\/lower-courts-set-address-questions-kiobel-left-unanswered\" target=\"_blank\">\u201cmere corporate presence\u201d in the U.S. is not enough<\/a>.<\/p>\n<p>A striking feature of this holding is the clear contrast between how a \u201cmere corporate presence\u201d in the U.S. is not enough for an ATS claim based on extraterritorial conduct, but <em>is<\/em> sufficient for a Foreign Corrupt Practices Act (FCPA) prosecution. Although Royal Dutch Petroleum\u2019s \u201cmere corporate presence\u201d in the U.S. was not a sufficient basis for an ATS claim, if these human rights abuses were tied to corruption for the retention or solicitation of business in Nigeria (and involved U.S. interstate commerce \u2014 <a title=\"FCPA and Interstate Commerce\" href=\"http:\/\/www.debevoise.com\/files\/Publication\/df7bf1bf-582b-4ceb-9070-d42a9d88cd42\/Presentation\/PublicationAttachment\/8691a513-e66f-4800-9947-e734d474cb5c\/Court%20Finds%20FCPAs%20Interstate%20Commerce%20Requirement%20Satisfied%20by%20Foreign%20Emails%20that.pdf%29\" target=\"_blank\">a requirement not difficult for the DOJ and SEC to overcome<\/a>), Royal Dutch Petroleum could be liable for FCPA violations. As a foreign multinational company, Royal Dutch Shell Company lists its shares on the <a title=\"Royal Dutch Shell Company and NYSE\" href=\"http:\/\/www.nyse.com\/listed\/rdsa.html\" target=\"_blank\">New York Stock Exchange<\/a> and <a title=\"Royal Dutch Company and SEC\" href=\"http:\/\/www.shell.com\/global\/aboutshell\/investor\/news-and-library\/sec-filings.html\" target=\"_blank\">prepares filings for the SEC<\/a>. Such activity is sufficient for <a title=\"FCPA and New International Norms\" href=\"http:\/\/books.google.com\/books?id=gV-72Zrit2gC&amp;pg=PR16&amp;dq=FCPA+and+new+international+norms+2nd+edition&amp;hl=en&amp;sa=X&amp;ei=5sY6U_PeO6insASQ8oDwAg&amp;ved=0CEYQ6AEwAA#v=onepage&amp;q=FCPA%20and%20new%20international%20norms%202nd%20edition&amp;f=false\" target=\"_blank\">establishing FCPA jurisdiction<\/a>.<\/p>\n<p>This suggests a possible strategy for human rights advocates dismayed by the <em>Kiobel<\/em> decision: Perhaps it might be possible to more aggressively utilize FCPA enforcement for circumstances in which corporate accountability for human rights abuses is tied to bribery. <a
