DESCRIPTION:Please join HIALSA Lunch talk with Stefan Kröll\, an independent Geman arbitrator and director of the Center for International Dispute Resolution at Bucerius Law School. We will discuss the topic of competition law in international arbitration. Since the U.S. Supreme Court in Mitsubishi v. Soler declared competition law disputes to be arbitrable\, claims arising under competition law have played a major role in arbitration in the US and Europe. The talk will give an overview on the specific problems arising in the arbitration context from the particular nature of competition law\, in particular\, its public policy elements from a European perspective. \nLunch will be served.

DESCRIPTION:Please join HIALSA for a lunch talk with Professor Frank Garcia and Brooke Güven on a critical analysis of third-party funding (TPF) in investor-state dispute-settlement (ISDS) cases. \nTPF of investment disputes is rapidly increasing\, as investors discover the high returns to be made by funding claimants in investor-state dispute-settlement (ISDS) cases. TPF proponents often defend the practice as enhancing access to justice\, in domestic litigation for indigent claimants and in commercial arbitration for small and medium-size business owners. SUMMARY:The Legitimacy Crisis of Investment Arbitration: Fake News or Valid Criticism?
DESCRIPTION:Discussion with Mr. James Boykin\, a Partner at Huges Hubbard & Reed on investment treaty arbitration. Investment treaty arbitration has been under increasing attack from critics who contend that the system limits states’ authority to regulate. This “regulatory chill” criticism is often accompanied by criticism that the participants in the system – arbitrators and counsel – have a vested interest in preserving the system for the benefit of multi-national companies. Recently\, Russia invoked such arguments before the Swiss Supreme Court to set aside two jurisdiction awards in international arbitration proceedings arising out of its expropriation of Ukrainian-properties in Crimea after the annexation of Crimea. Swiss Court announced that it would conduct public deliberations in October 2018. In his talk\, Mr. Boykin will survey the various criticisms raised against the system of investor-state dispute resolution and consider whether those criticisms are supported by facts.

DESCRIPTION:In HIALSA’s opening event for the academic year\, please join Three Crowns’ Gaëtan Verhoosel and Hugh Carlson for a candid Q&A about international arbitration.  The event will serve as an excellent opportunity for students to learn more about the practice of international arbitration\, including its advantages and disadvantages\, from one of its leading figures. \nTime will be allotted for audience Q&A.  Lunch will be served. \nGaëtan Verhoosel is a founding partner of Three Crowns and has served as the firm’s executive partner since its inception.  He has served as advocate and as arbitrator in a large number of commercial and investment treaty arbitrations\, some of which have been widely reported because of the significance of the financial recoveries at stake or the novelty of the legal issues involved.  Gaëtan is incoming Co-Chair of the IBA Arbitration Committee and was appointed to the ICSID Panel of Arbitrators by the Kingdom of Belgium.  He teaches international investment law at King’s College School of Law in London. \nPrior to co-founding Three Crowns\, Gaëtan was a partner and the global co-chair of the international arbitration practice at a prominent international law firm.  Prior to entering private practice\, he served as a Legal Advisor at the World Trade Organization in Geneva\, where he advised dispute settlement panels adjudicating disputes between sovereigns across a range of industry sectors.  Gaëtan has been ranked as a leading international arbitration practitioner in all major publications\, including Chambers UK\, Chambers (Global\, Europe\, and Latin America)\, PLC Which Lawyer (England)\, Legal 500 (UK)\, Legal 500 (Latin America)\, Who’s Who Legal\, and GAR’s 45 under 45. \nHugh Carlson is Director of Practice and a senior associate at Three Crowns\, where he serves in a leadership role and practices international commercial and investment arbitration.  He has represented multinational companies and sovereign states under most major arbitral rules systems.  Hugh is an adjunct professor at Georgetown Law School and co-directs the International Arbitration Workshop at Harvard Law School.  He is recommended in Legal 500 and has been recognized as a “Rising Star” by Super Lawyers (2016-2018).  He is a member of the CPR Cybersecurity Task Force.

Professor Reyes will discuss the creation of the International Commercial Courts\, which is a transnational court with judges from various jurisdictions sitting on the bench to decide international commercial disputes. Such courts are an alternative to international arbitration and domestic litigation. \nProfessor Anselmo Reyes (A.B. Harvard ’80\, Ph.D./LL.M./B.A. Cambridge) is an International Judge of the Singapore International Commercial Court\, which was founded in 2015 and is one of the first major example of an international commercial court. He is also former judge of the Hong Kong High Court\, Professor of Legal Practice at the University of Hong Kong\, and Representative of the Asia-Pacific Regional Office of the Hague Conference on Private International Law.
