Lunch Event – Professor John Hasnas: Hobbes v. Hayek

Professor Hasnas will articulate two different legal world views: A Hobbesian/Lockean one, and a Hayekian one, and argue in favor of the Hayekian world view. The Hobbesian/Lockean view requires the conscious regulation of citizens’ behavior by politically determined state agents. The Hayakian view advocates regulation that evolves through a common law learning process that does not involve political power struggles. The distinction between the world views and the superiority of the Hayekian view will be illustrated by how each would address recent controversial cases such as the false reporting of a campus rape story at UVA by Rolling Stone, and the failure to indict the police officers who killed Mike Brown and Eric Garner.
